Voluntary departure allows an individual to leave the U.S. at their own expense, rather than facing a removal order. When an a person is deported or removed by force from the country, it may bar their reentry for several years and may also result in criminal and civil consequences if the person were to attempt to reenter the U.S. without proper permission. On the other hand, voluntary departure gives the person the ability to avoid any bar from legal reentry to the country and protects them from any penalties associated with reentry.
There are three different forms of voluntary departure, depending on the stage of the proceeding when granted.
