Adjustment of status is a special benefit allowing a person to obtain permanent residency without having to travel abroad and be readmitted with an immigrant visa. A person may seek adjustment prior to the institution of removal proceedings or within the proceedings themselves.
When the benefit is being sought in removal proceedings, it is a form of relief from removal. In addition to meeting the criteria for a favorable exercise of discretion, a person also must have been admitted or paroled, not be statutorily ineligible, and have an immigrant visa immediately available in order to qualify for adjustment.
